WebManiac BV is committed to your privacy. That is why we only process data that we need for the functioning or improvement of our services and handle the information we have collected about you and about how you have used our services very carefully. We will never put your data at the disposal of any third party for commercial purposes.
This privacy policy applies to the use of our website and the services that WebManiac BV subsequently provides. This privacy policy will be valid as of 25/05/2018, all older versions of this privacy policy will no longer be valid from the date of publication of the latest version. This privacy policy describes the data we collect from you, what we use this data for and with whom and under which conditions this data is shared with third parties. We also explain how we save your data and how we protect your data against misuse and which rights you have in relation to the personal data with which you have provided us.

With regard to the processing of data

Below you can read how we process your data, where we save it or have it saved, which security measures we use and who has access to this data.

1. Web shop software: OScommerce

Our web shop was developed with OSCommerce software, we have chosen Holbi Group Ltd to develop this software. Personal data that you provide us with to use our services, is shared with this party. Holbi Group Ltd has access to your data to offer (technical) support, they will never use your data for any other purpose. Holbi Group Ltd is obliged to take appropriate security measures under the agreement we have with them. These security measures consist of SSL-encryption and a strong password policy.
They make regular back-ups to prevent loss of data. 

2. Web hosting: Holbi Group Ltd

We purchase web hosting and email services from Holbi Group Ltd. Holbi Group Ltd processes personal data on our behalf and does not use your data for their own purposes. It is possible that this party collects metadata about the use of their services. This is not personal data. Holbi Group Ltd has taken appropriate technical and organisational measures to prevent loss and unauthorised use of your personal data. Holbi Group Ltd is obliged to treat your data as confidential on the basis of the agreement. 

3. Email and Mailing list

3.1 MailChimp

We use MailChimp to send our email newsletters. MailChimp will never use your name or email address for its own purposes. At the bottom of every automated email sent by our website you will find the ‘unsubscribe’ button. After clicking this button, you will no longer receive our newsletter. Your personal data is securely stored by MailChimp. MailChimp uses cookies and other internet technologies that allow us to see whether emails have been opened and read. MailChimp reserves the right to use your data to improve their services and to share information with third parties on that basis.

3.2 Holbi Group Ltd 

We use the services of Holbi Group Ltd for our day-to-day corporate email traffic. This party employs appropriate technical and organisational measures to prevent misuse, loss or corruption of your data and ours as much as possible. Holbi Group Ltd does not have access to our inbox and we treat all our emails as confidential. 

4. Payment Processors

4.1 MultiSafepay

We use the MultiSafePay platform to process (part of) the payments in our web shop. MultiSafePay processes your name and address as well as your payment details such as your bank account number or credit card number. MultiSafePay has taken appropriate technical and organisational measures to protect your personal data. MultiSafePay reserves the right to use your data to improve their services and to share (anonymised) data with third parties on that basis. All guarantees mentioned above in relation to the protection of your personal data also apply to the parts of MultiSafePay’s services for which they employ third parties.
MultiSafePay will not store your data for longer than is allowed according to legal norms.

4.2 Paypal 

We use the PayPal platform to process (part of) the payments in our web shop. PayPal processes your name and address as well as your payment details such as your bank account number or credit card number. PayPal has taken appropriate technical and organisational measures to protect your personal data. PayPal reserves the right to use your data to improve their services and to share (anonymised) data with third parties on that basis. In the event of a request for deferred payment (credit granting) your personal data and information related to your financial position will be shared with credit checkers. All guarantees mentioned above in relation to the protection of your personal data also apply to the parts of PayPal’s services for which they employ third parties.
PayPal will not store your data for longer than is allowed according to legal norms.

5. Shipment and Logistics: Bpost and FEDEX

When you place an order with us, it is our job to ensure the package is delivered to you. We use the services of Bpost and FEDEX to execute the deliveries. It is necessary that we share your name and address with Bpost or FEDEX for this purpose. Bpost and FEDEX only use this data to execute the agreement. In cases where Bpost and FEDEX use subcontractors, Bpost and FEDEX will also share your data with these parties. 

Aims of data processing

1. General aim of processing 

We only use your data to facilitate our services. That means the aim of process the data is always related to a service you request. We do not use your data for (targeted) marketing. If you share your data with us and we use this data to contact you at a later date, and you have not directly requested we contact you, we will explicitly ask your permission to do so. Your data is not shared with third parties, unless it is necessary for bookkeeping and other administrative purposes. These third parties are obliged to keep your information confidential based on the agreement we have with them and/or based on legal requirements.

2. Automatically collected data

Data that is automatically collected by our website is processed with the aim of improving our services. This data (for example your IP address, web browser and operating system) do not constitute personal data.

3. Cooperation in fiscal or criminal investigations

In certain cases, WebManiac BV will be legally obliged to share your data with government authorities in light of fiscal or criminal investigations. In such a case we will be obliged to share your data, but we will do our best to resist sharing your data whenever legally possible.

4. Storage Period

We save your data as long as you are our customer. This means we save your customer profile until you let us know that you would no longer like to make use of our services. If you inform us of this, we will consider this a request to be forgotten. Due to applicable administrative obligations we are obliged to keep invoices with your (personal) data on them, this data will be kept by us for as long as we are legally obliged to do so. Our employees will no longer have access to your customer profile or to documents that we have produced based on your requests, however.

Your rights 

Based on the relevant Belgian and European laws you have certain rights in relation to the personal data that is processed by us or on our behalf. We will explain what those rights are and how you can invoke those rights below.

In principal we only send statements and copies of your data to an email address that is already known to us, to prevent any misuse. If you wish to receive data on another email address or for example by post, we will ask you to send us a form of ID. We have an administrative system that tracks processed requests, in the case of a request to be forgotten, we work with anonymised data. You will receive all statements and copies of data in a machine-readable format that we use in our own system.

You have the right to file a formal complaint with the Data Protection Authority at any time if you suspect that we are using your personal data in an unauthorised manner.

Right of inspection

You have a right of access to the data that we process or have processed and that are related to your person at any time. You can request access from our privacy affairs officer. You will receive a response to your request within 30 days. If we grant your request, we will send you a copy of all your data including an overview of the processors who have access to this data and of the categories under which we have saved this data to the email address known to us.

Right to rectification

You have the right to have data that we process or that is processed on our behalf, and that relates to your person, changed. You can request a change from our privacy affairs officer. You will receive a response to your request within 30 days. If we grant your request, we will send you a confirmation that your data has been changed on the email address that is known to us.

Right to limitation of processing

You have the right to limit the data that we process or that is processed on our behalf and that are related to your person at any time. You can request a limitation from our privacy affairs officer. You will receive a response to your request within 30 days. If we grant your request, we will send you a confirmation that we will no longer process your data until you request to have the limitation lifted.

Right to transferability

You have the right to have the data that we process or have processed and that are related to your person, processed by a third party. You can request this from our privacy affairs officer. You will receive a response to your request within 30 days. If we grant your request, we will send statements and copies of all data related to you that have been processed by us or on our behalf to the email address that is known to us. It is highly probable that we will no longer be able to provide any services at this stage, because we cannot guarantee the safe transfer of your data.

Right of opposition and other rights

When applicable, you have the right to oppose to processing of your data by or on behalf of WebManiac BV. When you oppose we will immediately stop processing your data pending the processing of your objection. If your objection is founded, we will send you statements and copies of data that we process or have processed and then we will permanently cease the processing of your data.

In addition, you have the right not to be subjected to automated individual decision making or profiling. We do not process your data in a way that this right is applicable. If you are of the opinion that this is, in fact, the case, please contact our privacy affairs officer.

Cookies

The use of cookies”

During a visit to our website, cookies can be placed on the hard drive of your computer. The sole purpose of this is to customise the site to the needs of the returning visitor. These mini-files or cookies are not used to track the user’s surfing behaviour on other websites. Your internet browser will allow you to block the use of cookies, will send you a warning when a cookie is being installed and allows you to delete the cookies from your hard drive afterwards. Google Analytics

Cookies from the American company Google are placed via our website, as part of their “Analytics”- service. We use this service to monitor and receive reports on how visitors use our website. This processor could be obliged to provide access to this data based on relevant laws and regulations. We collect information about your surfing habits and share this data with Google. Google can interpret this information in relation to other sets of data to monitor your movements on the internet. Google uses this information to offer other targeted advertisements (Adwords) and other Google services and products.

We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy has consequences for the way we handle data that we have already collected, we will inform you via email.
